This presentation addresses potential future problems in drug-impaired driving and creates awareness of dangerous drug trends for prosecutors and law enforcement. This session will cover the fundamentals of voir dire with specific examples of how to plan and design questions around the theory of the case and potential defenses particular to these types of cases. Officers, you will learn ways to help your prosecutors during voir dire. The venire has been impaneled. Who do you keep? Who do you dismiss for cause? How would you use your peremptory challenges? Drug-impaired driving cases, including the use of narcotic analgesics, central nervous system (CNS) stimulants, CNS depressants, cannabis, and other drugs, are common, though a DRE may not always be available. Officers can still make a solid DUI case without a DRE. This session will discuss and review what officers should do when contacting a drug-impaired driver when a DRE is unavailable, including documentation, gathering additional evidence, presenting the evidence to your prosecutor, and more.

In many DUI-drugs cases, the officer’s testimony links the signs and symptoms of impairment and the toxicological and physical evidence. This session will address the direct examination of the officer and how to lay a foundation to admit the evidence properly.
